Every tenant of Shropshire Council signs a Tenancy Agreement. The Tenancy Agreement is a legal contract between you the ‘Tenant’ and Shropshire Council, the ‘Landlord’, for housing services.
Council tenants holding a tenancy that was created before the new unitary Shropshire Council came into being on 1 April 2009 will have signed a tenancy agreement with either Bridgnorth District Council or Oswestry Borough Council. The rights and responsibilities under these older agreements have been transferred by legal statute to the new Shropshire Council.
We will be consulting widely with tenants to seek your views on all council tenants in Shropshire having the same Shropshire Council tenancy agreement. This will establish a common understanding of the tenancy terms and conditions between neighbours and local communities.
What does the Tenancy Agreement contain?
The Tenancy Agreement sets out:
- your responsibilities as a tenant
- Shropshire Council’s responsibilities as a landlord
What are the different types of Tenancy Agreement?
There are two types of tenancy agreement:
- if you have been a tenant for at least 12 months you are a SECURE council tenant
- if you have been a tenant for less than 12 months you will probably be an introductory tenant. You have fewer rights if you are an introductory tenant – but as long as there are no problems during the first 12 months of your tenancy you will automatically become a secure tenant. You then get the full rights of a secure tenant.
Joint tenancies
More than one person can hold a tenancy. This is known as a joint tenancy. Each tenant is jointly and individually responsible for abiding by the conditions of the tenancy.
Joint tenancies are usually offered to married couples or couples that can demonstrate that they have had a relationship for at least 12 months. Where a tenancy is joint, both parties must be over 18 and must sign the tenancy agreement.
