Licensing Act 2003 - Premises licences

To provide late-night refreshments, regulated entertainment and to sell alcohol you will need to have a Premises Licence issued from the local authority in which the premises is situated. This will involve completing the appropriate application forms, providing some additional information and having an advertised 28 day consultation period.

Applying for a New Premises Licence

All the forms and information sheets detailing the relevant information for making an application are attached to this page.

Initially you must complete the New Premises Licence Application form. Part 3 of this form consists of your operating schedule which shows the hours and activities you require. When completing each box in Part 3 (P) you must show that you have taken into account the four licensing objectives:

  • the prevention of crime and disorder.
  • public safety.
  • the prevention of public nuisance.
  • the protection of children from harm.

Once you have completed this form it needs to be sent to us accompanied by:

  • A plan of the premises. This must be at a scale of 1:100 (unless previously agreed in writing), with a red line drawn around the licensable area.
  • A completed form of consent (if you wish to sell alcohol) - this must be done by the person you wish to become the Designated Premises Supervisor (please note this person must hold a personal licence). It is possible that if the premises is a community, church or village hall a management committee can be responsible for supplying alcohol. In which case the disapply application form needs to be completed.
  • The fee (see schedule attached to this page).

Copies of your completed application form and accompanying documents need to be sent to all responsible authorities on the same day it is sent to us (see schedule attached to this page for further information on these).
 
You must also advertise your application in the following way:

  • Local newspaper - this must appear on at least one occasion during the first ten days of the consultation period.
  • Site notice - needs to be A4 size, on pale blue paper and displayed for the full 28 day consultation period.

Copies of these also need to be sent to us, and please remember when putting a date on your advertisement that the consultation period does not start until the day after the application is received by us.

Once the application has been received by us you will receive an acknowledgement letter. This will give details of any further information we may require, and state details on the consultation dates.

Following the consultation period, if no objections are received and we are satisfied that your application complies with the four licensing objectives, your licence will be issued to you.

If representations are received during the consultation period you will be contacted to ask whether you wish to amend your application in light of these. If you do not wish to make changes, the matter will be referred to the council's Licensing & Safety Committee for determination.

Applying to vary an Existing Premises Licence

Once a premises has been granted a licence you can apply to vary the operating schedule.

Should you wish to do this, you must complete the Vary Premises Licence application form. Part 4 of this form consists of your operating schedule where you will enter details of the changes to be made.  
 
When you have completed this form it needs to be sent to us accompanied by:

  • The fee (see schedule attached to this page)
  • The premises licence, including a copy of the plan.

Copies of your completed application form and accompanying documents need to be sent to all responsible authorities on the same day it is sent to us (see schedule attached to this page for further information on these).
