Following the recent announcement from Defra that charging a fee for a personal search of the Local Land Charges Register is incompatible with the Environmental Information Regulations 2004(EIRs) and the underlying 2003 EU Directive, the government has revoked the current £22 fee by amending the Local Land Charges Rules 1977.
The amendment came into force on 17 August 2010. The regulations allow for reasonable costs to be charged for making the information available, and Shropshire Council is in the process of reviewing this, together with its procedures.
What is the difference between an official search and a personal search?
A personal search is a search of the register of local land charges and does not include information from the Con29.
An official search made at the local authority has a statutory provision for compensation under the terms of the Local Land Charges Act (1975) section 10(3) if the local authority makes any error on the search. This provision does not apply when a personal search is carried out.
Procedures for personal search companies from 1 April 2009
To make an appointment for a personal search of the Local Land Charges Register please telephone 01743 252609.
Appointments will be made on a first come, first served basis and the number of properties will depend on availability.
The Local Land Charges Department is not located with the planning departments from Oswestry, north Shropshire, south Shropshire or Bridgnorth, and it is therefore necessary to contact them separately if you require copies of planning permissions or information regarding withdrawn or refused applications.
If an answer to a part of the Con29(R) is required, two options are available: you can either complete the form by following the link on this page and submit it to the Local land Charges Department together with the appropriate fee, or you can obtain the information free of charge from the relevant departments.
