Community Infrastructure Levy (CIL)

What is the levy?

The Community Infrastructure Levy provides a fair and transparent means for ensuring that development contributes to the cost of infrastructure required to support development. In Shropshire, 90% of the Levy will be spent on local infrastructure priorities that will be identified in partnership with the local town or parish council. 10% of the Levy will be spent on strategic infrastructure that benefits all of Shropshire.

Planning applications

In Shropshire, the Levy only applies to applications for new dwellings. Householder development under 100 square metres (1,076 square feet) and non-residential uses are not affected.

The Levy applies to all new dwellings (except affordable housing) that involve new build. It also applies to any residential annexes that are over 100sqm (1,076 square feet) in size. From October 2011, all such planning applications must complete CIL form 5 Notice of Chargeable Development, available to download below. If the landowner is accepting liability for the Levy, form 5 is sufficient. If liability is to be transferred to another party (for example, to a developer) then please also complete CIL form 1. Completed forms should be either attached to your planning application, or if sent separately, post to the CIL team, Shropshire Council, 5th floor, Shirehall, Abbey Foregate, Shrewsbury SY2 6ND or email to cil@shropshire.gov.uk.

CIL Levy Rates

The Levy rates for different types and locations of development are set out in the CIL Charging Schedule, which is available to download at the bottom of this page. In summary, eligible developments that receive planning consent on or after 1st January 2012 will be charged the following Levy:

  • £40 per square metre of new residential development in Shrewsbury, the Market Towns and Key Centres
  • £80 per square metre of new residential development elsewhere
  • Nil Levy rate for affordable housing
  • Nil Levy rate for employment-related and other non-residential types of development

Adoption of the CIL Charging Schedule

The Charging Schedule underwent consultation in January and April 2011, and an independent examiner concluded that it complies with the Planning Act, CIL regulations and statutory guidance, and recommended that it be approved. The CIL Charging Schedule is due to be adopted by Shropshire Council on 24th November, to come into effect for all planning permissions granted from 1st January 2012.

Compliance with European legislation

National CIL legislation and guidance was carefully designed to ensure that Charging Schedules that followed the statutory framework would be 'state aid compliant' and meet the requirements of European legislation.
