Waste from any commercial building is not household waste. You have to take out a contract and pay for commercial waste to be collected or disposed of as you would with any other utility. It is illegal for commercial waste to be put out for the household waste collections or taken to any of our Household Recycling Centres.
The Duty of Care
The Environmental Protection Act 1990 imposed a 'duty of care' on all businesses to make sure their waste is properly stored, collected and disposed of. This applies to any business or commercial activity which produces waste.
What to do with commercial waste
All businesses must make sure that:
- their waste is safely stored in proper containers.
- they clear up spillages and waste being blown away.
- their waste is only given to a licenced professional.
- a transfer note is jointly signed, with company collecting their waste.
- a copy of the transfer note must be kept on file for two years.
Repeated transfers of the same kind of waste between the same parties can be covered by one transfer note for up to one year. Failure to comply with all of the above duties shall be liable to prosecution under section 34 (5) and (6) of the act.
Environment Agency
The Environment Agency regulates waste activities.
