Mental Capacity Act

The Mental Capacity Act applies to everyone over the age of 16. Mental capacity in this sense means the ability to make decisions for yourself. This means that for the majority of young people, once they reach 16, decision making responsibility moves from their parents, to the young person. For some young people, their special educational need or disability may impact on their ability to make decisions.
